These Terms of Service (“Terms”) govern the access to and use of all websites, livestreams, sports breaks, commerce activities, and purchasing transactions offered by Showtime Shopping, Inc., d.b.a. Flash Bang Authentics (“FBA,” “we,” “us,” or “our”), including those conducted through TikTok Shop, Shopify, eBay, Whatnot, Fanatics, and any related online or offline channels (“Sales Channels”). By accessing any Sales Channel or completing a purchase from FBA, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

1. General Conditions

FBA reserves the right to update, modify, suspend, or discontinue any part of our offerings at any time.

These Terms incorporate by reference the following policies:

  • Shipping & Delivery Policy

  • Sports Break Policy

  • Refund & Warranty Policy

  • COA & Authenticity Policy

  • Promotions & Giveaways Policy

  • Privacy Policy

In the event of a conflict between these Terms and a platform’s mandatory rules (TikTok, eBay, etc.), the platform’s rules control for that transaction.

2. Use of Sales Channels

Flash Bang Authentics operates on multiple sales channels, including TikTok Shop, Shopify, eBay, Whatnot, and Fanatics. Each platform has its own mandatory seller and buyer policies. Flash Bang Authentics complies with all applicable platform rules, including their requirements for order fulfillment, shipping, returns, delivery timeframes, prohibited content, and buyer protection.

All break entries must be purchased through an official sales channel and checkout method supported by Flash Bang Authentics. Only entries completed through an approved checkout method are eligible to receive items revealed in the break. You agree not to engage in fraud, interference, harassment, multi-account manipulation, chargeback abuse, or the use of automated systems. FBA may deny or terminate access for violations of these Terms.

In the event of any conflict between the Flash Bang Authentics Terms of Service and the mandatory policies of the platform through which the purchase was made, the platform’s rules shall control.

For all matters not expressly governed by platform policy, the FBA Terms of Service, Sports Break Policy, Shipping & Delivery Policy, COA & Authenticity Policy, and Refund & Warranty Policy shall apply.

By completing a purchase through any FBA sales channel, receiving delivery of a purchased item, participating in a live break, or otherwise engaging in a transaction with FBA the customer agrees that Flash Bang Authentics’ published policies apply to the extent permitted by the platform and applicable law.

TikTok Shop and Other Platform Compliance

Sports breaks, live events, and all product listings offered through platforms like the TikTok Shop are conducted in accordance with the platform’s seller terms, commerce policies, and community guidelines. Flash Bang Authentics does not conduct gambling, raffles, lotteries, or games of chance. All breaks are entertainment openings of sealed collectible products, where customers receive the items corresponding to the team or category associated with their purchased entry.

If any provision of these Terms is found unenforceable by a platform or by law, that provision shall be interpreted as narrowly as necessary, and all remaining terms shall remain in full force and effect.

3. Purchases and Payments

All purchases are final upon completion, subject only to the Refund & Warranty Policy and applicable platform rules. Prices and product availability may change without notice. 

4. Sports Break Participation

Purchases made to participate in sports breaks are treated as standard purchases. Break participation is governed by the Sports Break Policy.

By participating, you acknowledge:

  • Break results are unknown until revealed.

  • Breaks conducted fairly and impartially.

  • Box/bag selection is a random event.

  • No specific outcome is guaranteed.

  • Purchases are final once teams/divisions/categories are assigned. 

  • Results are final when item revealed.

  • Dissatisfaction with results is not grounds for refund.

  • FBA is not responsible for any losses incurred in your sports break participation.

  • You are responsible for verifying your assigned spot before the break begins.

5. Breaker Discretion

All disputes arising from a live sports break are subject to the sole discretion of the breaker performing the break to handle disputes in a fair and equitable manner. Live sports breaks are conducted in real time, and issues may occur. These procedural issues do not constitute a difference in the total outcome, as you are either on the break or you are not, and the item is unknown until revealed. Unresolved disputes are limited to the total cost of your purchase. FBA reserves the right to void the entire break for any reason.

6. Break Results & Items Shipped

Participants will receive the items revealed that correspond to their assigned team or category. Breaks are chance-based entertainment events. Participants may receive items of greater or lesser value than the purchase price. 

Promotional Inserts

Occasionally, FBA may include low-value trading cards or promotional inserts as packaging material or courtesy items.

These items:

  • Are not guaranteed.

  • Have no assigned monetary value.

  • Are not part of the purchased product.

  • Are not intended as compensation or consolation items.

7. Shipping & Delivery

Shipping, tracking, risk-of-loss, carrier responsibilities, delays, and delivery standards are governed by the Shipping & Delivery Policy. Customer is responsible for providing accurate shipping information.

8. Returns, Refunds & Warranties

All returns, refunds, and warranty limitations are governed exclusively by the Refund & Warranty Policy. Autographed items, break items, and Customized Items are generally final sale unless misdescribed or required by platform rules.

9. Authenticity & Certificates of Authenticity

Autograph authenticity, third-party authentication disclosure, warranty limitations, and dispute procedures are governed by the COA & Authenticity Policy.

10. Promotions, Giveaways & Loyalty Programs

All giveaways, sweepstakes, and loyalty-based promotions are governed by the Promotions & Giveaways Policy. All Promotions are void where prohibited.

11. Intellectual Property & Customization Notice

FBA sells football helmets and memorabilia, including items modified, chromed, repainted, refinished, or customized (“Customized Items”), created by independent third-party artists or by FBA.

No Affiliation

FBA is not affiliated with the NFL, MLB, NBA, NCAA, any professional or collegiate team, Riddell, Schutt, Vicis, Xenith, or any manufacturer. All player, team, and league references are descriptive only and do not imply endorsement.

Intellectual Property Rights in Custom Artwork

  • Custom artwork, finishes, chrome applications, and paintwork may include decorative or thematic elements.

  • Customers receive no rights to reproduce, copy, distribute, or commercialize such artwork.

  • FBA retains rights in original designs created by contracted house painters. 

  • Third-party painters retain rights to their respective artwork.

Descriptive Use

Any resemblance to team colors or branding is for descriptive or decorative purposes only and is not licensed or endorsed.

Manufacturer Warranty Limitation

Customized Items are sold for display purposes only. Any manufacturer warranty is void once an item has been customized.

Customer Acknowledgment

By purchasing a Customized Item, the Customer acknowledges:

  • The item is altered from its original manufactured state.

  • Customization is cosmetic and not intended for athletic use.

  • No endorsement or affiliation is implied.

  • All rights remain with their respective owners. There is no intent to infringe.

12. Condition of Memorabilia & Inspection Period

All memorabilia sold through FBA is sold as-is. Minor imperfections, including but not limited to light scuffs, paint rubs, paint marker streaks in autograph, factory defects, or minor abrasions, are considered normal for display-grade collectibles and do not constitute defects.

Customers are responsible for inspecting their items upon delivery. Issues item must be reported in writing within three (3) calendar days of delivery. After this period, no claims regarding condition will be accepted, and the item will be considered accepted in the condition received.

We do not offer refunds, exchanges, or replacements for items exhibiting normal wear or factory-related imperfections.

13. Valuation and Fitness for a Particular Purpose

We do not guarantee the value of any item—the resale market for autographed memorabilia is subject to fluctuation. All collectible sports memorabilia products are sold as-is. FBA makes no representation or warranty that any item is fit for resale, investment purposes, or any specific commercial intent. Buyers are solely responsible for determining the suitability of an item for any particular use beyond personal collection or display.

14. Limitation of Liability

To the fullest extent permitted by law, FBA is not liable for indirect, incidental, special, or consequential damages. FBA’s total liability shall not exceed the amount paid for the transaction in question.

15. Dispute Resolution

Where allowed by law, disputes shall be resolved through binding arbitration in California.
If prohibited by platform rules, the platform’s dispute resolution procedures control.

16. Governing Law

These Terms shall be governed by the laws of the State of California.

17. Amendments & Updates

Flash Bang Authentics reserves the right to update these Terms at any time. Any changes will take effect immediately upon posting. Continued participation in sports breaks or purchases constitutes acceptance of the revised Terms.
